Alternative Dispute Resolution (ADR) refers to the ways people can resolve disputes without a trial. We are professionally trained Mediators/Arbitrators who can provide internal or external dispute resolution. MEDIATION VS ARBITRATION

The main distinction between the two is who makes the final decision. With mediation, the final decision is a reached agreement between the two conflicting parties, while arbitration calls on an arbitrator to analyze the case details and reach a verdict.  

Facts on mediation:

  • Negotiation style: parties decide outcome.
  • Mediator guides and helps parties define and understand issues and each side’s interests.
  • More informal than arbitration.
  • Results are more mutually satisfactory.

Facts on arbitration:

  • Arbitrator listens to facts and evidence and determines an outcome.
  • Attorneys and discovery are more prevalent.
  • More formal than mediation.
